I know someone who has a secret alixir that he says helps grow hair. He wants to paten it but he told me recently that he found out that he would have to list EVERY SINGLE ingredient when filing...is this true?

The answer is, yes and no. Yes, unless you apply for and receive Trade Secret status. But, a hair tonic would also involve FDA approval, and even then you have to list some though not all ingredients and not percentages used in your formula. You can share this link with your friend for more info. http://www.fda.gov/Cosmetics/Labeling/ucm414211.htm.

Hope that helped,
Laurie

A patent owner has the right to decide who may – or may not – use the patented invention for the period in which the invention is protected. In other words, patent protection means that the invention cannot be commercially made, used, distributed, imported, or sold by others without the patent owner's consent.

To get a patent, specialized data about the innovation should be revealed to the general population in a patent application. What rights does a patent give? A patent proprietor has the option to conclude who may or may not utilize the licensed innovation for the time frame in which the development is secured.
