Product liability is the area of law in which distributors, manufacturers, suppliers, retailers, and others who make products available to the public are held responsible for the injuries those products cause.

When a product is defective, there are various legal avenues you will pursue so as to recover compensation.

In most countries, customers are protected by law when they purchase defective products from legally-operating stores. Customers are permitted to return the defective product in exchange of a functional one or receive a refund if there are no alternatives available. In other cases, customers can also sue the manufacturer or producer if the product harmed the user during usage. I remember a case where a lady managed to sue McDonald's over their extremely hot coffee. The suit made mention of McDonald's failure to inform the consumer that it would be hot and drinking it without waiting for it to cool down would cause non-serious, but painful, burns. The consumer won and McDonald's now has those "Warning: Hot Coffee, etc." warning on their coffee cups.

The consumers are always protected from such products. If found selling such products you might land in trouble depending on the laws of the country. I hope that people get it that you are protected from such products.

It depends upon the country. Generally defective products are refundable and should be replaced by the owner, distributor, seller and the people who offer such products. Usually A 1 year guarantee or more is recommended and is given by the specific laws that govern the country.

There are various rules and regulations imposed by the law regarding the matter of defective products, however they varies from country to country. But in all the conditions they are made keeping consumer's interest in mind. As they are the one who gets affected because of the defected products, and they really need to be secured from it. Such laws may bring up the penalties or imprisonment to the manufacturer, distributor or even to the seller, even they can be asked to replace the product with the new one.

Defective products are the cause of many injuries year, lot of people become ill and also death due to the defective products. This liability claims are based on the types of defects and the basic elements are required to establish the liability. The product liability law is basically for the defective products.

The laws vary as per the company policies pertaining to replacement of such products. It is always better to read the terms and conditions so that it becomes easy while claiming for money-back or product replacement in case they are defective.
