View Full Version : Registering to Vend at an Out of State Event

I would like to register to do business temporarily at an out of state event.
The problem is that we are also a mail order company and wish to avoid creating a nexus in another state - is there any way of undertaking a temporary events registration?

To ellaborate:
If a business (in this case an LLC) is incoorporated in Delaware and it wants to do business (Vending footwear) in Virginia, It is required to register as a foreign LLC within the state of Virginia and appoint a registered agent within that state (Thus creating a nexus?). If this is a 4 day selling event, is it necessary to register perminantly?

Please help!

Frankly, I would be amazed if such a prescriptive rule was in place. If it was, where would it stop? What is the difference between selling there by mail order, or the internet, and you just popping over to sell?

I doubt you have nothing to worry about, but you might wish to check via the tax office in Virginia (see tax.virginia.gov).

Most states require transitory or transient sellers to enlist with the state and of an occasion, to guarantee charge is gathered from out-of-state or transient vendors.
